WASHINGTON — Lynda Marie Kirby sexually abused her young son in ways more horrible than anyone could imagine, and she'll pay a steep price for her crimes.

Kirby is serving a 125-year sentence, and she will remain in prison for half that time — 62 1/2 years — before she becomes eligible for parole.

But there are many in Texas who think Kirby shouldn't spend even another day behind bars. They believe crimes of her nature deserve a greater punishment than imprisonment, and now the state is on its way toward approving the death penalty for child rapists.

Texas is the latest state to pass a form of "Jessica’s Law" — named after 9-year-old Jessica Lunsford of Florida, who was abducted, abused, buried alive and left to die in a dirt hole by a known sex offender who lived nearby — that includes the death penalty.

The Texas bill reserves the death penalty for people who rape children under age 6 at least twice, or children younger than 14 if the crime also involves the use of a deadly weapon, alcohol or drugs, death threats, bodily injury, kidnapping or gang rape. Texas Gov. Rick Perry is expected to sign the bill into law.

I'm all for it.

Honestly, I'm more for the death penalty for child rapists than I am for murderers.

IMO, death is too easy, and its irreversible if a person is wrongfully convicted.

Have to say I agree under the right circumstances. DNA proof of sex with under 12's for example.

They would get more punishment in a regular prison to be honest, but I am all for death penalities for other crimes like murder I dont see why we should pay to keep them locked up, they wont come out again and they wont contribute fuck all to society so why keep them

The problem is, prison is for rehabilition... and with raping a child, there SHOULD be no rehab... and if you put them in prison, you are paying for them to live, eat, shit, and play for the rest of their life. No... a child rapist who has been convicted with irrefutible evidence (admission, DNA evidence, video taping, etc) needs to die.

I think we probably need to work on reducing the error rate of wrongful convictions in the capital cases we have before we start looking for exceptions to Coker v. Georgia.

Our adversarial system is severely screwed up in capital cases as it is. DAs and ADAs who want to move up in the world need convictions, and there's no booby prize for the DA/ADA that lets the wrongfully accused go free. Just as defense counsel usually willfully blinds themselves to the guilt of their clients when the need arises, DAs often do the same with innocent defendants. From the DAs perspective, the system is often more about "winning" than "the search for the truth." The "truth," whatever as it is, is something that is supposed to shake out during the interaction between prosecution and defense. For indigent defendants, you frequently see them with over-worked and underpaid (and, due to the low pay, often not top notch, even if they weren't overloaded) legal aid attorneys. In general, it's like matching the New York Yankees up against the Carolina Mudcats. Sure, the Yankees may not be that good by "big league" standards (this season), but they outmatch those not in the big leagues. (On the flip side, if you're wealthy, you can afford lawyers that outmatch those in the average DA's office.) He who has the best lawyer is not always he who wins, but it definitely has an effect in close cases (which a great deal of cases are).

I believe strongly in the death penalty, in principle, as a means of retribution for the victim's family. It's the errors in applying it that I find discomforting.

In Jessica Lunsford's case, the police failed to search the home which is heinous and sloppy in itself. If you were the parent, it would make you sick to know she was in his closet and they didn't even bother to do a thorough search of the premises. It is so frigging obvious as the first step in any investigation, it's disgusting.

The problem with these criminals is they act on it. The problem with society is there are a lot of these people who don't but don't care either. That is the lie and facade of a moral society. Most people are not good and that is the truth. Victims who survive know this as they have dealt with people who try to justify, minimize or even defend perpetrators to family members trying to keep them quiet to people revealing their true moral stands in private when these things are revealed while pretending to be good people in public. These same people society and the world consider 'normal' law-abiding people. You don't really know who they are and what they really think unless they are presented with a situation where they can reveal it. Many of these people will not be outraged, shocked or really care but be concerned with coverup, defending vice and mostly power because power is what they are most concerned about and living a lie. Most people in society identify with those who use or step on others to gain power and only buck or get upset when it's them or who they care about but not others. These people are not just trailer park trash but can be millionaires as I've personally dealt with them myself. They would care more about their vehicle than if someone was violated. It is deeply awakening and shocking to know that most people help eachother keep up their lies and facades and they outnumber the likes of you if you are a remotely honest person.

I don't care what puffed up delusions and lies people perpetrate about how good this universe is because there is something really, really wrong with it. Evil and scum are real and it is frigging alive.

i dont know, i personally do not think that anyone should die, and the death penalty has always been a big grudge of mine, but what can be done with child rapists and rapists of any sort come to think of it, i believe when they have done it once they will do it again.
