All the wireless routers I've installed have had WiFi enabled by default, because for the most part, they are sold to non-tecchies who want to do as little as possible to get up and running, and they buy them specifically for the wireless component. So it should come as no surprise it's switched on, really.

BTW, If you're gonna encrypt your router, then dont use WEP -it is useless encryption by today's standard, which can easily be compromised by any script kiddie in a matter of minutes.
Always use WPA, in conjunction with mac address filters if really nervous...

And the knowledge to use it.

It isn't. By law it also isn't. It's only illegal to use wireless networks if they have a password on them.
