They said the law only applied to people who were perminant employees. not visiting people. She will be able to sue them for damages now. i imagine they will be forced to offer tax payer money to settle out of court.
It was a set-up (politically motivated I'm sure) as it was female undercover cops in the club who asked to pose with their face between her breasts. She said, OK, and they arrested her. It should be dismissed.
That's entrapment. The cop should be prosecuted. Entrapment: a law enforcement agent induces a person to commit a criminal offence that the person would have otherwise been unlikely or unwilling to commit. It "is the conception and planning of an offence by an officer, and his procurement of its commission by one who would not have perpetrated it except for the trickery, persuasion or fraud of the officer."
The sad thing is the legal system is setup to give cops an edge against civilians and when its your word against theirs the judge almost always gives cops the benefit of the doubt. So even if a cop entraps you, the judge doesn't really care if the cop had to break the law in order to catch you when you were clearly breaking the law to begin with.
