I was just at work thinking about this topic. Do you feel kissing an underage girl or guy is a crime? Would that make the person doing it a sex offender? Have you ever kissed someone underage?

There's a myriad of possibilities to question here, but generally what do you think?

How about if 2 underage people kiss? Are they sex offenders suddenly? What are the limits to this sort of thing? Your thoughts?!

There are gray areas, such as when the participant who is of age is still within a year or so of the underage participant, but if you're somewhere in your 20s, and they're underage, chances are you're doing nothing more than taking advantage of a young person's naivete.

What makes this perhaps morally wrong is that a very young person who is emotionally immature might not have the capacity to make a sound decision regarding sex. You're talking about people who might be completely driven by social pressures, and might forever regret what they do. If you're an adult, you know full well their motive, and you know what the consequences might be to them, so you're simply taking advantage. That's wrong, because it willingly and knowingly puts them in harm's way.

I'm going to avoid your "kissing" qualifier, because I'm afraid there's a questionable story attached to it, and I'd rather you didn't share. Just take the above under advisement, and hopefully it will influence your own decision-making going forward.

    1. Two children, both aged 6, kiss each other.
    2. A 35 year old mother kisses her 10-year old daughter.
    3. Two children, both aged 15, kiss each other.
    4. A 42 year old man kisses his 7 year old niece on the head.
    5. A 27 year old teacher kisses one of her 14 year old students on the mouth.
    6. A 34 year old man grabs a child who doesn't know him off the street, drags the child into an alley and kisses the child.
    7. A 28 year old man kisses a 17 year old girl who he met on the internet.

    There's quite a range here.

Is underage kissing abuse? It all rather depends, doesn't it?

Without being more specific, this question seems to me to be more or less a complete waste of everybody's time.

This has no relation to anything in my life good fellows, however I remember back in highschool and junior high students regularly kissing, and some even dating older people outside their school. I was bored at work and thought to myself, I wonder if anyone considers such things abuse of a sort and how? The question evolved into what is above.

What's curious to me is what about this girl I saw in school with a child, she was underage clearly and yet was this person responsible in prison? Should he have been? Should she have been? Did they both commit a crime together? Those are some more questions to consider thanks.

It's not a waste of time, it's an good question

This reminds me of something similar (not getting off track - this is related to discussion.......I'm getting to it)

So I was wondering if being in possession of your own or other family members naked childhood pictures could be grounds for arrest as child pornography. After checking various laws on the issue, apparently there are some places that seem to draw distinction from what they call "baby in the bathtub" and "children in a lucid sexual context".
There's also a lot of gray area in these laws (at least here in the U.S.), so its actually better to NOT have those kinds of pictures if you wanted to be safer than sorry LOL. any rate, as far as whether or not underage kissing is abuse, I think the first thing to do would be to give the kissing some sort of context (like James said). Grandma giving grandson a peck on the cheek is obviously a lot different than some individual > legal age participating in a french kiss with someone < legal age.

Your point is exactly why i'd like to have this discussion, that's a very interesting thought about having childhood photos etc.

Context is very important with this kind of thing, for instance the album Nevermind by Nirvana has a naked baby on it, but this is allowed:

Sex is stated (on ANY form you fill out!) as male or female, which are defined by genitalia or breasts. Lips (or kissing) has nothing to do with sexuality.

Kissing on the lips does not generally qualify as sexual, so probably not. It would have to be French kissing. Still, these days you never know. If an adult man were in a passionate embrace with a 13 year-old girl that went on for ten minutes, even with no tongues he might be arrested.
When I was fifteen, I had my first kiss, with a sixteen year old girl. So I guess the answer is yes. Even when I was seventeen and in college, I dated a high school girl for a few months and she was probably sixteen. But back in those days (1959-1961) the laws weren't so draconian and there was no danger of arrest.

As an adult I've never been turned on by kids so I've never had to worry about it. I dated women who were older than me. But I have a friend who, at age 50, got busy with a 16 year-old girl. Her parents ignored it for a while, assuming it was just teenage rebellion, but he was too stupid to break it off. Now he's a registered sex offender who can't get a job or cross the state line.
The whole concept of sexual activity as a form of child abuse originated around cases of adult men seducing young teenage girls (the "Lolita" story, which in my day most young people didn't think was particularly bad), or even doing weird stuff with prepubescent children of either sex (which everyone has always thought was really bad).

Since then it's been extended to 20 year-olds of either sex fooling around with 16 or 17 year-olds of the opposite sex. (I'll ignore gay people for now because it makes the grammar too complicated but basically the same concepts apply to them.) I have a friend whose son was 18.4 years old and he had sex with his girlfriend who was 17.6 years old. Everybody knew about it but one day her daddy got pissed off at him and had him busted. This was in the Bible Belt and he had to register as a sex offender and couldn't get a job. So he moved back to California to live with his mother. She dutifully took him down to the police station the next morning to register his change of address. The lady behind the counter read his report and started laughing. She tore it up and said, "Welcome back to the Golden State, son. Have a nice life."

So: commit statutory rape and for punishment you spend the rest of your life in California. Not bad!
You keep focusing on kissing, which is a grey area. If two 14 year-olds have actual intercourse, then technically they can both be prosecuted, and it has indeed happened. It's more common for just the older one to be prosecuted, or just the boy regardless of the age difference.

Not to say that it's common, but if the parents don't like it and they have some influence it can go really bad. It's a perfect way for the girl's parents to punish the boy's parents if they have a grudge against them.

do you mean the police officer behind the counter?

cali's laws regarding adult/minor relations seem to mirror that "bible belt" state and she tore up the report?
  17. Emil Valued Senior Member

It depends if there is also an implication of sexual attraction.
Also depends on the age of those involved, adult-adult, adult-minor, minor-minor.
  18. Fraggle Rocker Staff Member

I wasn't there so I don't know if it was an officer or an administrative employee.
Yeah but California is a big state and many areas are extremely liberal. The city nearest to us up in the northwestern corner of the state had a Green Party majority on the city council last time I checked.

If it were a romantic kiss between a child and an adult - that is abuse. It's actually grooming the child for further sexual activity.
  20. leopold Valued Senior Member

depends on which of those possibilities you wish to discuss.

    I hope you don't work at a day care.:bugeye:

Our laws on this subject in America are not based upon a true criminal standard, they are based upon moral democracy. Whatever the popular contemporary agreement is on a wrong or right behavior is what they consider law, not what actaully can be proven to be a crime.

It probably depends on how you kiss and where on the body you are kissing.

Yes. Lot of times. And all over their body. I'm well over 18 too. But when I did the kissing, I was a minor like them. So, ha ha. I kissed underaged girls! On the naughty spot too!
  22. steampunk Registered Senior Member

Well, it is becoming more and more popular to call normal sexual behavior between teenagers criminal. Teen sexting is a sexual offense in America. In a scientific sense I'm guessing that from their point of view, human genetics made a five to six year mistake. All this human evolution toward sexuallity beginning a 12 is a great big biological retardation and we need to morality to step in and bridge the retard gap until they are 18, or they are nothing but sex offenders.
